Why does GIVE receive requests from law enforcement agencies?

During a criminal investigation, law enforcement agencies may ask us for information about owners, travelers, or vehicles that are relevant to the investigation. Our dedicated team of experts work to ensure that any information we disclose is consistent with our policies and applicable law.

What does GIVE do when it receives a request for community information from law enforcement?

GIVE is committed to protecting the privacy and security of our community. With limited exceptions, we require valid and sufficient legal process from official government agencies before we disclose any information, including prospective location data, about our community. When we receive a request from law enforcement, we review it to ensure it satisfies legal requirements. We require that requests are narrowly tailored to a legitimate law enforcement need. We object to overly broad, vague, or unreasonable requests.

Does GIVE always require law enforcement agencies to go through legal process to obtain information about its community?

No. In emergency situations, GIVE works expeditiously with law enforcement to ensure the safety of our community, the public, and the property of our community. We also proactively refer matters to law enforcement, or cooperate with law enforcement, when we believe that someone from the GIVE community has engaged in criminal activity while using the marketplace or GIVE is the victim of a crime. In these scenarios, we provide information without requiring legal process and we do not provide notice to those involved in the investigation.

Does GIVE provide notice to users of law enforcement subpoenas?

It is our policy to notify our community members of law enforcement subpoenas before disclosure, with exceptions for:

  • Emergencies and exigent circumstances
  • When we have an honest belief that notice would be counterproductive or would create a safety risk to safety
  • When GIVE is the victim of a crime
  • When we are prohibited by law from providing notice (i.e., statutory prohibition, court order, delayed notice).

Law enforcement officials seeking non-disclosure of legal process should provide the details of their investigation to us so that we can determine whether a request falls into one of these exceptions. In all other circumstances, law enforcement officials who do not want their request disclosed should obtain an appropriate court order establishing that notice is prohibited before serving legal process on GIVE.

Transparency report

GIVE has never provided information to law enforcement, including U.S. national security requests, where we required law enforcement to obtain a subpoena or search warrant. Please see the explanation above for the circumstances when we do not require legal process.

Law enforcement has never requested that GIVE remove user content or close any accounts.

The law enforcement request should include:

  • Legal basis for the request
  • Detailed specifics on the information sought
  • The name of the issuing authority, badge/ID number of the responsible agent or officer, an email address from a law enforcement domain, and a direct contact number for the responsible agent or officer.

If you are seeking prospective location information or the content of user communications, you should obtain a search warrant instead of a subpoena.

What we retain

We store and maintain information as described in our Privacy Policy and Terms of Service. This may include, among other things, a phone number, email address, name, IP address, rental transaction information, feedback, financial information, customer service communications, photos, address, device ID, or GIVE account number.
